Terms of Service

By accessing or using the Silicute website ("Site"), mobile application, or any services offered by Silicute ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use our Services.

These Terms constitute a legally binding agreement between you and H&E Global Sourcing, Inc., doing business as Silicute, a company registered in the State of North Carolina, United States ("Silicute," "we," "us," or "our").

We reserve the right to update or modify these Terms at any time without prior notice. Changes become effective immediately upon posting to the Site. Your continued use of the Services after any changes constitutes your acceptance of the revised Terms.

You must be at least 18 years of age to use our Services. By using the Site, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this agreement.

To access certain features of our Services, including placing bids in auctions, submitting wholesale inquiries, and tracking orders, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate your account at our sole discretion, without notice, for conduct that we determine violates these Terms.

You may delete your account at any time by contacting us at hello@silicute.com.

All products displayed on the Site are subject to availability. We make every effort to display product colors, images, and descriptions as accurately as possible.

Product prices are listed in U.S. Dollars (USD) and are subject to change without notice. Prices do not include applicable sales tax or shipping charges.

Submitting an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or suspected fraudulent activity.

Product specifications, dimensions, and weight capacities listed on the Site are approximate and provided for guidance only.

Silicute Auctions allow users to bid on products in a competitive, timed format. By participating in any auction, you agree to the following additional terms.

All bids are binding commitments to purchase. When you place a bid, you authorize Silicute to place a temporary hold on your payment card via PayJunction for the amount of your bid.

Authorization holds reserve funds on your card but do not constitute a charge. If you are outbid, the hold is automatically released within 1–3 business days.

PayJunction automatically voids any authorization hold not captured within six (6) calendar days. Auction durations will not exceed five (5) days.

The highest bidder at auction close wins. The winning bid is captured (charged); all losing bids are voided.

Auction items are sold as-is and are final sale. No returns except for damaged or materially different items reported within 48 hours.

We reserve the right to cancel any auction, void fraudulent bids, and suspend accounts engaged in bid manipulation or shill bidding.

All payments are processed securely through PayJunction, a PCI Level 1 compliant payment processor.

We accept Visa, Mastercard, American Express, and Discover credit and debit cards.

Silicute does not store your full credit card number, expiration date, or CVV. All sensitive payment data is tokenized by PayJunction.

For auction transactions, your card must remain valid with sufficient credit through the auction duration.

For wholesale orders with Net-30 terms, invoices are issued upon shipment. Late payments may incur a 1.5% monthly service charge.

We currently ship within the United States only. Standard shipping: 5–7 business days. Expedited: 2–3 business days.

Orders over $50 qualify for free standard shipping.

Shipping times are estimates, not guarantees. Silicute is not responsible for carrier delays.

Risk of loss passes to you upon delivery to the carrier.

It is your responsibility to provide an accurate shipping address.

Standard store purchases may be returned within 30 days of delivery for a full refund or exchange, provided items are unused and in original packaging.

Auction purchases are final sale. Damaged items must be reported within 48 hours.

Custom engraved items are non-returnable once the proof has been approved.

Memorial wholesale: unopened cases returnable within 14 days.

Refunds processed within 5–7 business days. Original shipping charges are non-refundable unless due to our error.

You will receive a digital proof for approval before engraving begins. Once approved, the order is final.

Errors attributable to Silicute will be remade at no cost.

Customer-supplied images must be high resolution (300 DPI minimum). Final responsibility for image quality rests with the customer.

By uploading content, you represent you own the rights or have obtained necessary permissions.

Turnaround: 3–5 business days after proof approval, plus shipping.

Wholesale pricing is available to verified businesses including veterinary clinics, pet cremation centers, and authorized resellers.

Volume discount tiers are based on total units per order and are subject to change.

Wholesale quotes are valid for 15 calendar days from issue.

Wholesale customers may not resell below MSRP without prior written consent.

Silicute reserves the right to limit quantities, refuse accounts, or modify pricing at any time.

All content on the Site — including text, graphics, logos, the Silicute name, the "Source-to-Shore™" mark, and software — is property of Silicute or its content suppliers and protected by U.S. and international IP laws.

You may not reproduce, distribute, or exploit any content without prior written permission.

The Silicute name, logo, and related marks are trademarks of H&E Global Sourcing, Inc.

Your use of the Services is governed by our Privacy Policy, incorporated by reference.

We do not sell, rent, or share your personal information with third parties for marketing.

You may request access to, correction of, or deletion of your personal data by contacting hello@silicute.com.

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

IN NO EVENT SHALL SILICUTE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SILICUTE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow these limitations. In such cases, liability is limited to the maximum extent permitted by law.

These Terms are governed by the laws of the State of North Carolina.

Disputes shall first be attempted through good-faith negotiation.

If negotiation fails, disputes shall be resolved through binding arbitration (AAA) in Guilford County, North Carolina.

Disputes will be conducted individually, not as class or representative actions.

Entire Agreement: These Terms, together with the Privacy Policy and Returns Policy, constitute the entire agreement.

Severability: If any provision is unenforceable, remaining provisions continue in full force.

Waiver: Failure to enforce any right does not constitute a waiver.

Force Majeure: Silicute is not liable for delays beyond our reasonable control.
